Terms of Use

Important — Surface Estimates

RollSense provides informational surface measurements. Ride scores and community observations can be incomplete or inaccurate and do not guarantee accessibility or safety. Conditions may change after a ride is recorded.

These Terms of Use ("Terms") govern your access to and use of the RollSense website (rollsenseapp.com), mobile applications, software, sensor telemetry processing, and related services (collectively, the "Services") provided by RollSense ("we", "us", or "our"). Please read these Terms carefully before using our Services.

1. Acceptance of Terms

By using our Services or creating a guest or linked account, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, you must not use the Services. This acknowledgment does not replace any separate consent required by law.

You represent that you are at least 13 years old (or the legal age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.

2. Service Scope & Surface Estimates

RollSense records active rides, analyzes location and motion telemetry, provides personal ride summaries, and offers Community Map access as a Premium feature. When using these features:

  • Measurement Limits: Results depend on sensor quality, phone mounting, positioning accuracy, and ride conditions. They may contain inaccuracies and are not official accessibility assessments.
  • Availability: Service interruptions, maintenance, or upload delays can affect when a ride summary or map observation becomes available.
  • Algorithm Evolution: Sensor processing thresholds, roughness classifications, and ride scores are actively calibrated and may be updated or recomputed at any time.

3. Safety, Medical & Navigation Disclaimer

CRITICAL SAFETY NOTICE: RollSense is an informational surface-sensing tool and is NOT a medical device, emergency navigation system, or guarantee of physical road safety.

You acknowledge and agree to the following essential safety conditions:

  • Informational Purposes Only: Ride quality estimates (such as "Smooth", "Moderate", "Rough", or "Difficult") and vibration indices are calculated estimates derived from smartphone motion sensors. They are provided solely for personal route reference and do not constitute an official assessment of road engineering, accessibility compliance, or physical safety.
  • Real-Time Rider Responsibility: You are solely responsible at all times for your own physical safety, navigation choices, speed control, and awareness of immediate surroundings. Never rely on RollSense estimations over your own direct visual observation and judgment of physical hazards, curb drops, steep slopes, cross-slopes, pedestrian traffic, or road obstacles.
  • Compliance with Traffic Laws: You must always adhere to all applicable pedestrian, sidewalk, road, and transit regulations in your local jurisdiction.

4. Safe Phone Mounting & Operation Guidelines

Reliable sensor telemetry requires secure smartphone attachment, but personal safety is always paramount:

  • Secure Mechanical Attachment: The smartphone must be securely fixed to your wheelchair frame, armrest, or handlebar using a stable, purpose-built phone holder.
  • No Interference with Operation: Ensure the phone mount and charging cables do not obstruct your hands, joystick, push rims, brakes, wheels, or field of view.
  • No Distracted Riding: Do not interact with the smartphone screen while your wheelchair is in motion. Start your ride before setting off, and review your ride summary only after coming to a complete and safe stop.

5. Accounts, Premium & Community Contributions

Guest Mode: RollSense creates a pseudonymous guest account so you can record rides without a social sign-in. Guest accounts are subject to the same contribution and retention practices as linked accounts. If you delete the app or clear device storage without linking an account, access to unlinked guest data may be permanently lost.

Linked Accounts: You may choose to authenticate via supported third-party providers (such as Apple or Google). You are responsible for maintaining the confidentiality of your authentication credentials and for all activities that occur under your account.

Account Deletion: Delete a guest or linked account from Settings → Delete Account after finishing and closing any active ride. Account access and identifying profile information are removed. Completed ride datasets, including raw GPS, timestamps, motion data, and processed measurements, are retained for development and model refinement after account detachment. They are not guaranteed anonymous. See the Privacy Policy and deletion instructions for the exact scope and your privacy rights.

Community Contributions & Your Preference

Community Map contribution is enabled by default for guest and linked accounts. Onboarding explains this default and lets you turn contribution off before recording a ride. You can change the same preference at any time under Settings → Privacy, without a Premium subscription. While enabled, eligible verified rides, including past rides, automatically contribute route sections and surface measurements to the Community Map.

Turning contribution off excludes your previous contributions from Community Map results and prevents new rides from contributing while the setting is off. Ride recording and your personal ride history remain available. Turning contribution back on makes eligible past rides visible again, including rides recorded while contribution was off. This preference controls map sharing and does not delete retained ride data or stop processing for personal summaries, quality review, and model development. See the Privacy Policy for details.

The current map omits approximately the first and last 50 metres of route geometry and does not display account names or emails, but these precautions do not guarantee anonymity. Map sections may reflect a single verified observation. Viewing the Community Map is currently a Premium feature, and missing or uncolored sections do not indicate that a route is safe or accessible.

Premium Subscriptions & Restore Purchases

Where offered, monthly and yearly Premium subscriptions are purchased through Apple's App Store or Google Play. The paywall displays the localized price and billing period before purchase. Subscriptions renew automatically unless cancelled through the relevant store before renewal. Manage cancellation, billing, and refund requests through the store where you purchased; uninstalling RollSense or deleting an account does not cancel a subscription.

Use Restore Purchases to restore eligible purchases associated with your store account. Access depends on a valid entitlement verified through RevenueCat and our backend. An interrupted purchase or restore does not establish an entitlement. Store terms and mandatory consumer rights continue to apply.

Contributor Rewards

Where a contributor reward is offered, the app displays the verified ride-minute goal and progress. Only eligible verified rides count; pending, rejected, discarded, or incomplete rides do not count as verified time. A Lifetime Premium reward is not a recurring paid subscription and does not provide a cash payment. Reward eligibility and activated Premium access are separate: the active entitlement determines feature access.

6. Acceptable Use & Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the RollSense application or backend algorithms.
  • Injecting synthetic, spoofed, or fraudulent GPS or sensor telemetry data to distort road roughness scores or community map layers.
  • Attempting to probe, scan, or breach the security, authentication, or rate limits of our APIs and servers.
  • Using the Services to track, harass, or monitor individuals without their explicit informed consent.
  • Reselling, sublicensing, or commercially exploiting raw telemetry data or proprietary route intelligence without our prior written permission.

7. Intellectual Property Rights

All right, title, and interest in and to the Services — including software, algorithms, machine learning models, heuristics, visual designs, trademarks, logos, and aggregated community map layers — are and remain the exclusive property of RollSense and its licensors.

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the RollSense application on your personal devices for personal, non-commercial mobility use in accordance with these Terms.

8. Feedback & Submissions

We welcome bug reports, suggestions, feature ideas, and survey responses to improve RollSense. By submitting feedback or suggestions, you grant RollSense an unrestricted, worldwide, perpetual, irrevocable, royalty-free license to use, implement, modify, and commercialize such feedback without any obligation of confidentiality, attribution, or financial compensation to you.

9. Third-Party Services

The Services use third-party providers including map and hosting platforms, Apple and Google sign-in and app stores, Firebase, Expo push delivery, PostHog, and RevenueCat. Their respective terms and privacy policies may apply. RollSense does not control the availability, accuracy, or content of third-party platforms.

10. Modifications & Termination

We may update, suspend, or discontinue features or restrict access for violations of these Terms, subject to applicable law and any required notice. Changes to paid access remain subject to store terms and mandatory consumer rights. Material changes to data practices are described in the Privacy Policy.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, OR STATUTORY.

ROLLSENSE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF ROAD/SURFACE DATA, ACCESSIBILITY COMPLIANCE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT SENSOR READINGS WILL PREDICT ALL ROAD HAZARDS OR ACCESSIBILITY OBSTACLES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROLLSENSE, ITS FOUNDERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, WHEELCHAIR ACCIDENTS, LOSS OF PROFITS, DATA LOSS, OR EQUIPMENT DAMAGE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICES.

IN JURISDICTIONS WHERE LIMITATIONS OF LIABILITY ARE RESTRICTED, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF FIFTY US DOLLARS ($50.00 USD) OR THE AMOUNT YOU PAID TO ROLLSENSE (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RollSense is organized, without giving effect to any principles of conflicts of law. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through good-faith informal negotiations prior to initiating any formal legal proceeding.
